Governing law - English/UK or Italian Dec 26, 2012

You are in Italy. The agency is in the UK.

Can we assume or are we supposed to guess then that the PO says, if anything, that either the law of England & Wales or Scotland vs. Italy applies?

This is a fundamental point that most translators or interpreters on this forum do not address.

This is a fundamental point that most translators or interpreters on this forum do not address.

But it is vital to pinpoint if the agency's end-users are a UK law firm or barristers' chambers who, traditionally in my experience - even if you are translating into a non-native language direction and in straitened, rushed circumstances - will offer to pay for your portion of the work on a *quantum meruit > what s/he deserved vs. *quantum valebat basis> what that fraction of the job was worth to them or to the agency on a time-apportioned basis as a part of the composite whole. Note that, in English contract law, *Latin tags and labels are used.

Just follow Rudolf Vedo's advice Dec 28, 2012

Remind them about payment if they do not pay by whatever deadline you have agreed and whatever grace period you feel like granting. Move on boldly and fear nothing.

Talk about putting the cart before the horse Dec 29, 2012

The client hasn't said anything and it doesn't sound as though payment is late.

You don't seem to be sure about the mistakes you made, it looks like you haven't bothered looking at the text again after the translation to see what you did wrong, once you know how good or bad the translation is you can have an idea of whether or not the client might be disappointed.

So before worrying about something that might or might not happen I would suggest:

So before worrying about something that might or might not happen I would suggest:

1- Reread your translation and redo it so that you are actually happy with the end result (unless it is so bad it would take a lot of hours to do, but that in itself would give you an answer) that will let you know if you have a possible problem, or not.

2.- Regardless of the result of 1 wait for the client to complain before you say anything.

Anything else is simply putting the cart before the horse.

DEAR ALL.... Dec 30, 2012

again thank you for all your comments.

I have never expected my English to be at native level, although when someone works full-time with natives acquires more self-sufficiency that - hélas - fades away a bit with time.

I have never expected my English to be at native level, although when someone works full-time with natives acquires more self-sufficiency that - hélas - fades away a bit with time.

When I started the self-employment - so late in life and with a lot of back experience - I was informed so many times that my work would be reviewed anyway, and by various agencies around the world, at first I was puzzled by this practice as I worked solo, but now I appreciate the advantages of being proofread anyway, even in Italian: sharing the work, giving something to do and a source of income to more people at different levels, sharing the responsibility to obtain a better output, so it's an acceptable practice after all.

I have sent a gentle reminder now that the project is three-week old with a polite request for operative details and for the payment, as I understand ProZ allows one full month as standard (like in Italian business). I understand all settlements should be done within the end of the financial/business year for the 2012....

Best to all for your advice and please do forgive imperfections mainly due to haste in writing...

A BANNED AGENCY Jan 10, 2013

Dear All,

today - by pure chance - I thought of checking this agency in the Blue Board. It was banned from publishing ads last summer, and recently they have not paid AT ALL.

Dear All,

today - by pure chance - I thought of checking this agency in the Blue Board. It was banned from publishing ads last summer, and recently they have not paid AT ALL.

Now I understand the feeling of being inadequate, the rush, the high pay promised in writing, the documents upside down for a more difficult readibility, etc.

I was feeling hopeless but .... let me wait a few more days before saying that I was cheated, and psychologically manipulated to feel unsuitable for payment.....

After a few polite useless reminders - with polite and useless replies - I have now written again saying that I've seen their Blue Board entries, and inviting to split the amount due and pay at least something now for personal stringencies.

But I do feel manipulated.

Regards....

It was a free advertisement that I found in a large competing translators website, the ad was removed after I accepted.

paid in full Jan 17, 2013

I was paid in full, so everything was perhaps just my fear to be confident in myself and in my professional choices of such a long time ago. Perhaps.

Thank you again everyone. I will put a 5-star recommendation for them, somewhere.

I'm happy for you that they paid. However, what you said about how the job was managed doesn't sound to me as though the company warrants a top write-up. Paying is certainly a point in their favour, but it shouldn't be the only consideration when rating them.

What about clear instructions, achievable deadlines, quick feedback... it doesn't sound as though they scored well on any of those.
