Die Beteiligten wurden durch den Notar darauf hingewiesen,

The wording of your sentence appears to give the answer.
The real estate is liable and thus the currently registered owner is liable.
It appears that the burden runs with the land and thus will be the responisibility of whoever owns the land.

You could say that the Notar advised them that the burden runs with the land and thus the current owners are liable oder quelque chose comme cela.
