Discussion

Barend van Zadelhoff Feb 4, 2023:
"after the order has been placed"

The information contained in the infographics below includes the award of mini-competitions or call-offs from established frameworks. The Council use several national framework providers including Scotland Excel and Scottish Government.
The Council maintains and publishes a contract register of contracts awarded on its website.
The contract register provides information on current contracts and can be viewed by suppliers to identify any future opportunities they may be interested in.

Call-Off Contract means any contract for the Supply of Services between a Framework Public Body and the Contractor entered into in accordance with the Award Procedures and based on the Standard Terms of Supply.

Call Off Procedure means the process for awarding a Call Off Agreement pursuant to Clause 5 (Call Off Procedure) and Framework Schedule 5 (Call Off Procedure);

What does Call-off mean?
The practice, under a framework agreement, of instructing specific works to be carried out. Depending on the structure and terms of the framework agreement, call-off may require a contract to be entered into or may just require a call off notice to be given by the instructing party.

Can call-off agreement under a framework agreement be awarded on different terms to those set out in the original framework? If a tenderer marks-up the call-off terms at mini-competition stage, could the contract be awarded and entered into based on the mark-up?

OJEU Guidance and Call Off Processes

Accessing Fusion21 frameworks ensures your organisation is complying with
OJEU principles and regulations. This guide explains the processes involved
in calling off a framework.

Calling Off a Framework
There are two ways to award call-offs (individual contracts) under a framework agreement:

Direct Award
When the terms given in the framework agreement are sufficient enough to cover
a particular requirement of a client, call-off contracts may be awarded without
reopening competition

Direct Call Off can only be undertaken to the highest ranked supplier/contractor to that particular framework. Those organisations who scored the highest in terms of quality and cost when the originally framework was undertaken are ranked highest on a framework.

Conducting a Mini-Competition will enable the right supplier/contractor to be appointed to reflect the particular circumstances and needs of a client.
This route to call off is often the best way of ensuring you gain best value and generate the highest possible efficiencies for a contract.

'call off' in the context of 'call-off order':

Call-off order arrangement

A call-off order is a purchase order which enables bulk orders over a period of time, and created to cover multiple supplies or deliveries from a single company. This is a form of framework agreement that is often used where projects can last for months or even years. Under call-off-stock arrangements, a supplier makes goods available to his customer by delivering them at the warehouse of the customer or a third party warehouse under control of the customer. The supplier retains legal title of the goods until the customer actually calls-off the goods, and removes them from the stock. At the time of removal, the goods are legally supplied to the customer.

https://txpcustoms.com/news/2019/5/23/how-to-handle-call-off...

Call-off stock is different to the consignment stock discussed at ¶65-130. Consignment stock is held in premises controlled by the supplier, whereas call-off stock is dispatched by the supplier to premises controlled by the customer. Although legal title only passes when the customer uses or ‘calls off’ the goods to meet his supplies, he has the right to dispose of the goods as if he were the owner on their transfer.

WHAT IS A CALL-OFF ORDER ? A Call-off Order is an order created to cover multiple supplies or deliveries from a single company. An order of this type can only be placed after the appropriate procurement requirements have been satisfied.

Call-off contract
A call-off contract, also known as a blanket order, is a purchase order which enables bulk orders over a period of time. This is a form of framework agreement that is often used in construction where projects can last for months or even years.

The benefit of using a call-off contract is that it allows the supply of materials to be secured over multiple delivery dates, meaning that a customer does not have to hold excess stock (e.g. all the bricks required to build a housing development) on site; instead they can ‘call off’ stock as and when it is required

A blanket order, blanket purchase agreement or call-off order is a purchase order which a customer places with its supplier to allow multiple delivery dates over a period of time, often negotiated to take advantage of predetermined pricing. It is normally used when there is a recurring need for expendable goods. Blanket orders are often used when a customer buys large quantities and has obtained special discounts. Based on the blanket order, sales orders ('blanket releases' or 'release orders') and invoice items can be created as needed until the contract is fulfilled, the end of the order period is reached or a pre-determined maximum order value is reached.

The language of the framework agreement uses a number of words and phrases that may be unfamiliar. These include:
(i) Call-off: the act of awarding a contract awarded under the framework agreement itself. It does not need to be advertised and tendered;

7. The key part of the framework agreement is how the call-off procedure works. Ideally this should be as follows:
(i) The employer will issue an enquiry in accordance with the framework agreement. The enquiry will detail what the proposed Task is;
(ii) Like a tender, the enquiry will include drawings, specifications, scope, etc. in other words all the information necessary for the potential provider to price the job;
(iii) The enquiry also sets out the terms of the “underlying contract”;
(iv) The provider can then price the task in accordance with the information provided, albeit that the framework will have established the basic pricing mechanisms;
(v) The pricing and contract terms are then negotiated and a completed order will be issued or called off. The order will include the terms under which the provider will carry out the tasks.

Elke geverifieerde emissiereductie credit vertegenwoordigt één ton CO2-reductie (mtCO2e).
